Terms and conditions

  1. scope
    All legal transactions that are concluded via the online shop mona-kollektiv.ch (hereinafter referred to as “online shop”) fall under the general terms and conditions (hereinafter referred to as “GTC”). This online shop is managed by Simone Schregenberger (hereinafter referred to as “MONA.kollektiv”). MONA.kollektiv reserves the right to change these terms and conditions at any time. The version valid at the time of the order is decisive. This can be viewed at https://mona-kollektiv.ch/agb.
  2. offer
    The products and prices in the online shop are considered an offer. The offer is valid as long as the product can be found in the online shop and is in stock.
  3. products and prices
    MONA.kollektiv can set the prices freely and change them at any time. When ordering, the price published on the website is decisive. If prices have been published in error, MONA.kollektiv reserves the right to inform the buyer before shipping in order to agree on a price correction or to cancel the order. The prices are given in CHF by default. The shipping and packaging costs are included in the stated price as standard. If this is not the case, they will be shown separately. Any cash on delivery by the logistics partner or customs duties are borne entirely by the customer.
  4. Information Provided
    MONA.kollektiv strives to keep the data published in the online shop up to date and correct. However, errors may occur due to sales through other channels. Therefore, all information on availability and delivery time is not guaranteed and can change at any time.
  5. conclusion of contract
    The purchase contract is concluded when the order is sent (online) and accepted by MONA.kollektiv.
    The prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided on the Internet and the acceptance of the present General Terms and Conditions.
    MONA.kollektiv confirms receipt of the order with an automatically generated order confirmation email. This only shows the customer that the order has arrived and that the purchase contract has been concluded under the condition of delivery and the correct price.
  6. Terms of delivery
    6.1 Availability and delivery
    Physical products marked as “available” are normally dispatched within 0 – 3 working days between Monday and Friday from receipt of the order. There is no shipping on Saturdays and Sundays. If a product is not in stock or is incorrectly marked as “available”, the customer will be informed of this by email and a new provisional delivery date will be agreed.
    If an item is no longer available, MONA.kollektiv can withdraw from the contract, but the customer must fully refund any payments already made for the product in question.
    If MONA.kollektiv is not able to provide or ship the items within 30 calendar days of receipt of the order, the customer has the right to withdraw from the contract. Payments already made by the buyer to MONA.kollektiv for the product in question will be fully refunded. There are no further claims against MONA.kollektiv.
    If additional shipping costs arise due to an incorrect delivery address or incorrect address data, these costs are borne entirely by the buyer.
    Unless otherwise agreed, MONA.kollektiv sends national and international orders with Swiss Post. The provisions, information and delivery times of Swiss Post apply.

    Digital products (e.g. embroidery templates) are available for the buyer to download after payment and are not physically shipped. If the buyer does not receive a download link, the buyer can contact MONA.kollektiv in writing by email ( info@mona-kollektiv.ch ) or Instagram DM.

    6.2 Additional Provisions Delivery
    If the customer does not accept the goods delivered by the supplier within the agreed or specified delivery times, MONA.kollektiv can withdraw from the contract, cancel the order and charge the customer a processing fee of 15%, but at least CHF 30.

  7. inspection obligation
    The delivered products are to be checked by the buyer for completeness, correctness and delivery damage immediately after acceptance. If there is a defect, this must be reported to MONA.kollektiv within 7 calendar days. The product must be in its original condition for a return.
  8. Guarantee conditions and benefits
    MONA.kollektiv manufactures goods by hand, so the delivered product may differ slightly from the photo shown. The Swiss statutory warranty provisions according to Art. 197 ff. OR apply.
    A guarantee claim can only be asserted by the customer upon presentation of the purchase contract including a valid order form.
    There is no warranty claim for damage caused by improper handling or defects that can be traced back to external influences. This could be, for example, elemental damage, moisture damage, fall and impact damage or damage caused by modifications.
    MONA.kollektiv can provide the warranty service by replacing the product as good as new.
  9. Liability and Disclaimer
    MONA.kollektiv is only liable for the guarantee services, which are listed under no. 8 are listed. Any further liability is excluded, in particular liability for damage that has not occurred to the products themselves. This can be indirect and indirect damage and consequential damage. In addition, MONA.kollektiv is not liable for damage caused by improper storage or use.
  10. payment
    The goods invoice is to be paid in the currency specified therein and immediately upon or after sending the order. PayPal and Twint are accepted as means of payment in the online shop.
  11. Right of withdrawal and cancellation
    Orders for digital and physical products cannot be returned, exchanged or cancelled. If problems arise or the ordered product does not meet the expectations, the customer can contact MONA.kollektiv in writing. A bilateral solution is being sought.
  12. privacy
    MONA.kollektiv only collects personal data that is necessary for the conclusion of the contract. These will not be processed further without the separate consent of the buyer.
    The data will only be passed on to third parties if this is necessary for the processing of the order. In the case of home delivery, this applies to the logistics partner (e.g. Post, DHL, etc.) and to the bank for payment processing.

  13. application of law
    The relationship between MONA.kollektiv and the customer is exclusively subject to Swiss law.
